The Convention Refugee Determination Division of the Immigration and Refugee Board determined that Sivamoorthy was not a Convention refugee. Sivamoorthy applied for judicial review.

Admission - Refugee protection - Convention refugees and persons in need of protection - Right to a fair hearing - Sivamoorthy claimed refugee status based on her race and membership in a particular social group (Tamils from northern Sri Lanka facing persecution from Sri Lankan authorities and the Liberation Tigers of Tamil Eelam), as well as her imputed political opinion - The Convention Refugee Determination Division (CRDD) decided that Sivamoorthy was not a Convention refugee - The CRDD found that Sivamoorthy failed to demonstrate with credible evidence that she was a Tamil woman who was present in northern Sri Lanka at times material to her claim - The Federal Court of Canada, Trial Division, allowed an application for judicial review and set aside the CRDD's decision - Sivamoorthy was denied natural justice where the CRDD misled her into believing that the issue of identity was resolved and then refused her claim based primarily on that issue - The CRDD's error was egregious and even if its other findings with respect to recent presence in the north and general credibility were valid, a new hearing was required.
