The Ontario Labour Relations Board ordered that two employees be reinstated to jobs with Sobeys Inc. Sobeys Inc. appealed and sought an interim stay of the reinstate­ment order.

The Ontario Divisional Court granted the stay.

Labour relations boards and judicial review - Procedure - Stay of proceedings - So­beys Inc. ran a nonunion store - Two employees had access to a secured room wherein, inter alia, confidential information about company employees was kept - Without permission the employees used the information to compile a list of employees and their telephone numbers for a union - One of the employees was fired and the other quit when her employment was restricted - The union complained and the Ontario Labour Relations Board ordered that the employees be reinstated - Sobeys Inc. appealed and applied for an interim stay of the reinstatement order - The Ontario Divisional Court granted the stay.
