Summary:

The plaintiff motorcyclist suffered injuries in a collision with a truck driven and owned by the defendants, who were impecunious. The motorcyclist elected to receive the statutory benefit under the Automobile Accident Insurance Act. Saskatchewan Government Insurance accordingly paid the motorcyclist $200,000, being the maximum amount payable under s. 42(2)(e) of the Act. The issue in this case was whether the statutory limit included prejudgment interest.

The Saskatchewan Court of Queen's Bench held that the limit prescribed by s. 42(2) of the Automobile Accident Insurance Act included prejudgment interest.
