(Appeal No. 14718)

Indexed As: Suncor Inc. v. McMurray Independent Oil Workers Local No. 1

Alberta Court of Appeal

Haddad, Kerans and Belzil, JJ.A.

November 4, 1982.

Summary:

A worker filed a grievance respecting his entitlement to overtime work. The grievance was referred to an arbitration board. The arbitration board dismissed the grievance. The grievor's union applied to the Alberta Court of Queen's Bench to set aside the board's decision. The Alberta Court of Queen's Bench allowed the application. The decision of the court is not reported in this series of reports. The employer appealed to the Alberta Court of Appeal.

The Alberta Court of Appeal allowed the appeal, set aside the decision of the Alberta Court of Queen's Bench and restored the decision of the board of arbitration.

Arbitration - Topic 8308

Judicial review - Grounds, general principles - Consensual versus compulsory arbitrations - The Alberta Court of Appeal stated that the "patent unreasonableness" test is the standard of review whether an arbitration is classified as consensual or compulsory (see paragraph 25).

Arbitration - Topic 8403

Judicial review - Grounds, misconduct - Patently unreasonable test - The Alberta Court of Queen's Bench set aside the decision of a consensual arbitrator (interpreting a collective agreement) because the record disclosed an error in law - The Alberta Court of Appeal restored the decision of the arbitrator because the Court of Queen's Bench should have applied the "patently unreasonable" test and not the "error of law" test (see paragraphs 26 to 28).
