Interest as damages - On insurance proceeds - The plaintiff brought an action against the defendant insurer to determine the amount of the loss payable under an insurance policy for machinery damaged by fire - The Supreme Court assessed the loss in access of the amount the insurer had been willing to pay - The Supreme Court reviewed the law of interest and held that the court had the power to award interest as damages on the amount payable under the policy - The Nova Scotia Supreme Court, Trial Division, awarded the plaintiff interest at 5 per cent for 6 months on the amount of the assessed loss - Paragraphs 11 to 26.
