Summary:
Constable Symington was the subject of an internal disciplinary proceeding within the Halifax police force. The investigation was completed after the 60 days allowed by the Police Act Regulations (N.S.) had expired. The investigator applied to the Chairman of the Nova Scotia Police Review Board for an extension of the time to complete the investigation (Regulations, s. 21(3)). The Chair extended the time. Symington challenged the Chair's decision by way of an application for certiorari.
The Nova Scotia Supreme Court dismissed the application.

Internal organization - Discipline of members - Limitation periods - Judicial review of decision respecting - Section 21(3) of the Police Act Regulations (N.S.) provided that the Chair of the Nova Scotia Police Review Board could, upon request before or after the time limit had expired, extend the time to complete a disciplinary investigation of a member where the Chair of the Review Board was satisfied that there were reasonable grounds for granting the extension and the extension would not unduly prejudice any member - The Nova Scotia Supreme Court held that the standard of review of the Chair's factual determinations under s. 21(3) and his exercise of discretion within what the legislation provided was at the highest level - However, where the Chair implicitly or explicitly interpreted s. 21(3) so as to identify the limits of his jurisdiction, the standard was correctness - See paragraphs 7 to 13.
