Summary:

The plaintiff, Talisman Energy Inc., sued the defendants, alleging, inter alia, breaches of contract, breaches of fiduciary duties, misappropriation, conversion and conspiracy. In that context, a Master denied the plaintiff's request for access to personal tax records of individual defendants. The plaintiff appealed.

The Alberta Court of Queen's Bench allowed the appeal.

Discovery - What documents must be produced - Documents related to or relevant and material to matters in issue - The plaintiff, Talisman Energy Inc., sued the defendants, alleging, inter alia, breaches of contract and fiduciary duties, misappropriation, conversion and conspiracy - In that context, a Master denied the plaintiff's request for access to personal tax records of individual defendants on the basis that the information was not relevant or material - The plaintiff appealed - The Alberta Court of Queen's Bench, considering the matter de novo, allowed the appeal - The court held that the test of relevance and materiality applied to all records in an action, including tax records - Here, the plaintiff had adequately demonstrated relevance and materiality - However, to protect the defendants' privacy the court ordered that the personal tax records be provided in the first instance to the individual defendants' counsel, who could redact information that was both private and irrelevant to the plaintiff's claims and then provide the redacted records to the plaintiff.
