Summary:
The plaintiff, an Ontario resident, was injured when she fell off a truck in Alberta. She commenced an action in the Ontario Superior Court of Justice against the truck's owner and operator, who lived in Alberta, and its corporate co-owner, which was registered and carried on business in Alberta. She also sued her Ontario automobile insurer. A motion judge stayed the action against those defendants. The plaintiff appealed.
The Ontario Court of Appeal dismissed the appeal. The plaintiff's insurance contract was not a sufficient "presumptive connecting factor" under Club Resorts Ltd. v. Van Breda (2012 S.C.C.) to give the court jurisdiction over the non-resident defendants.
