Summary:

The plaintiff was a member and officer of the Saskatoon Civic Employees' Union, Local 59. The plaintiff brought three actions for defamation against the union and union officers. The plaintiff then brought this action under the simplified procedure, claiming judgment against the union for $50,000 for reimbursement of costs incurred by him in advancing his first three actions. The plaintiff argued that he was involved in union related litigation and he was therefore entitled to the benefit of an indemnity provision in the union's bylaws. The plaintiff applied for summary judgment under Queen's Bench Rule 485. The union argued that the plaintiff misinterpreted the indemnity clause and further that the court should decline to become involved in the dispute because the union was a voluntary association and was entitled to resolve its own disputes.

The Saskatchewan Court of Queen's Bench held that the dispute was essentially contractual in nature and the court had jurisdiction to entertain the plaintiff's claim. The court dismissed the plaintiff's application for summary judgment where it was plain and obvious that his claim was grounded on an interpretation of the indemnity clause that was so illogical and inconsistent with its plain wording that it could not succeed. The court also dismissed the plaintiff's action.
