Summary:

A teacher was employed as an instructor under contract to provide instruction to older teenagers and adult students. The teacher was covered by a collective agreement. The teacher began to demonstrate behaviour that was unusual and disruptive. She was advised by the school board to undergo a psychiatric examination pursuant to s. 92(2)(b) of the School Act, or be summarily dismissed. She did not unequivocally refuse to attend an appointment, but ultimately never did attend, and was dismissed pursuant to s. 92(3) of the Act. The union grieved the teacher's dis­missal.

An arbitrator determined that ss. 92(2)(b) and 92(3) did not violate the teacher's right to life, liberty and security of the person in s. 7 of the Charter of Rights. The union appealed the arbitrator's award pursuant to s. 100 of the Labour Relations Code.

The British Columbia Court of Appeal, Prowse, J.A., dissenting, dismissed the appeal. The court considered both ss. 7 and 8 of the Charter.
