Two defendants moved to strike out a portion of one of the plaintiffs' affidavits and all of a second affidavit, being rule 299 affidavits adducing evidence-in-chief in this simplified action.

A Prothonotary of the Federal Court of Canada, Trial Division, allowed the motions.

Registrars and prothonotaries - Jurisdiction - Case management - Rule 385(1)(d) of the Federal Court Rules, 1998, provided that a case management judge or a prothonotary assigned to assist in the management of a proceeding "shall deal with all matters that arise prior to the trial or hearing of a specially managed proceeding" and "may... hear and determine all motions arising prior to the assignment of a hearing date." - A Prothonotary of the Federal Court of Canada, Trial Division, rejected the argument that rule 385(1)(d) could be read as bringing case managers' jurisdiction to an end once a hearing date had been set - See paragraphs 3 to 5.
