Summary:

A female volunteer firefighter (Tessier) with the Halifax Regional Municipality (HRM) filed a complaint of discrimination based on sex and mental disability respecting how she, and other female firefighters, were treated by male firefighters. The Human Rights Commission assigned an investigator, who recommended that the discrimination complaint be dismissed under s. 29(4)(b) of the Human Rights Act for insufficient evidence to support the allegations. The Commission, performing its gate-keeping function, adopted the recommendation and dismissed the complaint without a hearing. Tessier applied for judicial review to quash the decision.

The Nova Scotia Supreme Court, in a judgment reported (2014), 341 N.S.R.(2d) 201; 1081 A.P.R. 201, quashed the Commission's decision and remitted the complaint to the Commission for reconsideration after a fresh investigation conducted by an investigator having no contact with Tessier's complaint file. Tessier was denied procedural fairness in the investigation of her complaint. Tessier sought costs against the Commission and the HRM.

The Nova Scotia Supreme Court awarded Tessier lump sum costs of $10,000 plus disbursements of $518.34. The Commission and the HRM were equally liable for costs.

That being said, costs have been awarded where there has been a breach of procedural fairness or other misconduct on the decision-maker's part, or where it has demonstrated a notable lack of diligence." - See paragraph 11.

Judicial review - Practice - Costs - A female volunteer firefighter with the Halifax Regional Municipality (HRM) filed a complaint of discrimination based on sex and mental disability respecting how she, and other female firefighters, were treated by male firefighters - The Human Rights Commission assigned an investigator - After several extensions, the HRM consultant taxed with preparing the response of the Chief and Deputy Chief failed to file a response or seek further extensions - The investigator advised Tessier that the allegations of discrimination would be considered unchallenged due to the lack of a response - However, the investigator then contacted the consultant for information and offered a further extension to file a response, which the consultant did - The investigator advised Tessier that a response was received and more witnesses needed to be interviewed - Several months later, the investigator left HRM employment - The file was transferred to a new investigator - Nothing was done on the file for 1.5 years - The Chief and Deputy Chief were never interviewed - The investigator prepared a report recommending that the discrimination complaint be dismissed under s. 29(4)(b) of the Human Rights Act for insufficient evidence to support the allegations - The Commission, performing its gate-keeping function, adopted the recommendation and dismissed the complaint without a hearing - Tessier's application for judicial review to quash the decision was allowed and the matter was remitted for reconsideration following a fresh investigation - Tessier was denied procedural fairness where the Chief and Deputy Chief, key witnesses who had obviously crucial evidence, were not interviewed by the investigator - Tessier sought costs against the Commission and the HRM - The Nova Scotia Supreme Court held that "it would be contrary to the public interest for the Commission to avoid liability for costs in situations where it has mishandled a complaint to the degree seen in this case" - The Commission and the HRM were jointly liable for lump sum costs of $10,000 plus disbursements of $518.34 - Tessier's legal costs approximated $20,000 - Awarding Tariff costs would not provide substantial indemnity as the most that could be awarded using the maximum multiplier (4) would be $8,000.
