Summary:
The City of Toronto filed a complaint with the Ontario Municipal Board (the board) that Metropolitan Toronto was operating a sewage treatment plant contrary to the Environmental Protection Act (Ont.). The board refused to hear the City's application. The City applied for leave to appeal.
A judge of the Ontario Divisional Court granted leave to appeal to the Divisional Court.
