Summary:

The plaintiff subcontractor brought a me­chanics' lien action against the defendant contractor and the City of Dartmouth. The city served a third party notice on its con­sulting engineers. The subcontractor applied to strike the third party notice.

The Nova Scotia County Court allowed the application. See 117 N.S.R.(2d) 446. The city appealed.

The Nova Scotia Court of Appeal allowed the appeal and set aside the decision of the Nova Scotia County Court.

Practice - Third party procedure, avail­ability of - A subcontractor filed a claim for lien against a contractor and the City of Dartmouth - The city served a third party notice on its consulting engineers - The Nova Scotia Court of Appeal held that the third party notice was valid because it arose out of the construction contract and the work and material supplied (as required by s. 34(2) of the Mechanics' Lien Act).
