Summary:

The union advised Ursel Constructors (Ursel) that Hudon requested that a permit holder be terminated so that he could replace him as provided for in the collective bargaining agreement. Ursel terminated the permit holder's employment but rehired him five days later to do the same work without advising the union or Hudon. The union filed a grievance and an arbitration board upheld the grievance. Ursel applied for judicial review setting aside the arbitration board award.

The Saskatchewan Court of Queen's Bench dismissed the application. The court held that the board did not exceed its jurisdiction and that the board's interpretation of the collective bargaining agreement was not patently unreasonable.
