Summary:

Quintin and Westphal were sought for extradition by the United States for the purpose of prosecuting them for offences allegedly committed in Colorado. Quintin was also sought for the purpose of prosecuting and sentencing for offences committed in California. The offences were: conspiracy to commit fraud, fraud, conspiracy to launder proceeds of crime and laundering proceeds of crime (Colorado offences) and perjury, fraud and failure to appear (California offences). Issues before the extraditing judge included: an application for an adjournment based on several grounds; an application to stay the extradition based on a s. 7 Charter violation (i.e., immigration proceedings amounting to a disguised extradition); a discharge application under s. 14(1)(b)(ii) of the Extradition Act; and the merits of the extradition request.

The Ontario Superior Court denied the adjournments and discharge applications. The court discussed the evidentiary issues before concluding that there was ample evidence to commit Quintin and Westphal on all offences, except for the perjury charge against Quintin in the California request.
