Attorney General of Canada on behalf of The United States of America (respondent/requesting state) v. Ariel Julian Savein (appellant/person sought)

Ariel Julian Savein (applicant) v. Minister of Justice (respondent)

(CA040505; 2014 BCCA 290)

Indexed As: United States of America v. Savein

British Columbia Court of Appeal

Levine, Garson and Stromberg-Stein, JJ.A.

July 17, 2014.

Summary:

Savein was committed for surrender for extradition to the United States for prosecution for offences corresponding to the Canadian offence of laundering proceeds of crime. The Minister of Justice ordered Savein surrendered to the United States on the United States offence of conspiracy to launder monetary instruments. Savein appealed the committal order and applied for judicial review of the surrender order. He asserted that there was insufficient evidence to commit him for extradition, and the decision to surrender him was unreasonable because the Minister failed to consider the relevant factors in concluding that his surrender would not violate his s. 6(1) Charter rights and that it would not be unjust or oppressive in light of his personal circumstances.

The British Columbia Court of Appeal dismissed the application and the appeal.
