Summary:

Counsel for Mr. Yakimyshyn wanted to file a notice of motion for leave to appeal from a consent judgment after leave to appeal was refused by a Queen's Bench judge. The Registrar refused to permit filing. Counsel for Mr. Yakimyshyn sought a fiat to permit filing of the notice of motion for leave to appeal.

The Alberta Court of Appeal, per Côté, J.A., refused a fiat to permit filing of the proposed notice of motion and directed the Registrar not to accept it.
