Summary:

The Minister of Citizenship and Immigration sought a declaration, pursuant to s. 18(1)(b) of the Citizenship Act, that Halindintwali (defendant) obtained his permanent residence status, and consequently his Canadian citizenship, by false representation or fraud or by knowingly concealing material circumstances.

The Federal Court granted the declaration. The court held that the Minister had established, on a balance of probabilities, that the defendant acquired Canadian citizenship by fraud and by concealing material circumstances when he applied for permanent residence. The court was not convinced on a balance of probabilities that the defendant had committed a crime or crimes against humanity.

Naturalization - General - Revocation (incl. loss of citizenship) - The Minister of Citizenship and Immigration sought a declaration, under s. 18(1)(b) of the Citizenship Act, that Halindintwali (defendant) obtained his permanent residence status, and consequently his Canadian citizenship, by false representation or fraud or by knowingly concealing material circumstances - The Minister claimed, inter alia, that the defendant falsely stated that he was Burundian, and not Rwandan, in order to enable him to be accepted as a refugee by Canadian authorities and lied when he claimed he did not participate in crimes against humanity in Rwanda - The Federal Court reviewed the legal framework on a proceeding under s. 18, including the burden and standard of proof and the legal test - In the result the court granted the declaration - The court held that the Minister had established, on a balance of probabilities, that the defendant acquired Canadian citizenship by fraud and by concealing material circumstances when he applied for permanent residence (e.g., his place of birth, marriage and citizenship) - The court was not convinced on a balance of probabilities that the defendant had committed a crime or crimes against humanity - See paragraphs 22 to 128.

Naturalization - General - Revocation (incl. loss of citizenship) - The Minister of Citizenship and Immigration sought a declaration, pursuant to s. 18(1)(b) of the Citizenship Act, that Halindintwali (defendant) obtained his citizenship by false representation or fraud or by knowingly concealing material circumstances (incl. that he had participated in crimes against humanity in Rwanda) - An RCMP investigator, in his affidavit, presented as evidence a number of exhibits that had been submitted to the International Criminal Tribunal for Rwanda (ICTR) - The Federal Court considered the certified documents from the ICTR to be admissible as evidence under the authority of s. 23 of the Canada Evidence Act - The court opined that although the ICTR was not a court of a "foreign country", it could be likened to an international court of several countries, and there was no reason to doubt the authenticity of the documents in question because the copies included in the file were certified by the ICTR, which was created through a resolution of the United Nations Security Council - See paragraphs 94 and 95.

Naturalization - General - Revocation (incl. loss of citizenship) - The Minister of Citizenship and Immigration sought a declaration, pursuant to s. 18(1)(b) of the Citizenship Act, that Halindintwali (defendant) obtained his citizenship by false representation or fraud or by knowingly concealing material circumstances (incl. that he had participated in crimes against humanity in Rwanda) - An RCMP investigator, in his affidavit, referred to a number of out-of-court witness statements to support the allegation the defendant had participated in genocide - The witnesses were not called to testify - The Federal Court held that the criteria of necessity and reliability were not met such as to justify admissibility of the witnesses' out-of-court statements - The court opined that even if it had admitted the out-of-court statements of the witnesses, it would have accorded little probative value to that evidence - The court stated that it was insufficient to rely on hearsay evidence to support a conclusion that a person committed a crime against humanity when the Minister had not convinced the court it would have been impossible or unreasonable to produce better evidence - See paragraphs 104 to 118.
