Summary:

The Minister of Citizenship and Immigration notified Wysocki of the Minister's intention to request that his citizenship be revoked on the basis that he obtained Canadian citizenship by false representation, fraud, or by concealing material circumstances. The Minister alleged that he failed to disclose that he was charged with an indictable offence between the time he applied for citizenship and the time he took the oath of citizenship. Wysocki requested that the matter be referred to the court.

The Federal Court held that Wysocki obtained his Canadian citizenship by knowingly concealing material circumstances.

Naturalization - Disqualifications - Pending charge for indictable offence - The Minister of Citizenship and Immigration notified Wysocki of the Minister's intention to request that his citizenship be revoked on the basis that he failed to disclose that he was charged with an indictable offence between the time he applied for citizenship and the time he took the oath of citizenship - Wysocki requested that the matter be referred to the court - He could not recall having seen the warnings respecting pending indictable charges on either his application for citizenship or his notice to appear to take the oath of citizenship - He alleged that, at the relevant time, he still had difficulty with English and was experiencing difficulties in his personal life - The Federal Court held that Wysocki obtained his Canadian citizenship by knowingly concealing material circumstances - He selectively chose to ignore the warning paragraphs - He wilfully omitted to disclose that which he knew he ought to have disclosed - Wilful omission constituted "knowingly concealing" within the meaning of ss. 10(1) and 18(1)(b) of the Citizenship Act - See paragraphs 1 to 21.
