This case arose out of an action commenced in the State of Illinois by the plaintiff Dovenmuehle. The defendant, Rocca Group Ltd, a New Brunswick resident, entered an appearance in Illinois for the purpose of protesting the jurisdiction of the Illinois court. The protest was dismissed and the defendant withdrew from the jurisdiction. The plaintiff took default judgment in Illinois and then commenced an action in New Brunswick to enforce its judgment under the Foreign Judgments Act. The New Brunswick Court of Queen's Bench, Trial Division, allowed the action and directed judgment in favour of the plaintiff for $53,654.00. The judgment of the trial court is reported at (1981), 33 N.B.R.(2d) 223; 80 A.P.R. 223. The defendant appealed to the New Brunswick Court of Appeal.
The New Brunswick Court of Appeal allowed the appeal, set aside the judgment of the trial court and dismissed the action against the defendant. The Court of Appeal held that the defendant's appearance in Illinois did not constitute a voluntary submission to the Illinois court for purposes of the New Brunswick Foreign Judgments Act (see paragraph 29).
