Summary:
Spouses separated in 1998 after five years' marriage and divorced in 1990. The spouses had joint custody of their two sons, now aged 14 and 13, with the mother being the primary caregiver and the father having reasonable access. The father agreed to pay $350 per month support for each son. Several months thereafter, the mother agreed to accept $200 per month per child. In 1998, the mother moved to Alberta with the sons and her fiancé. The father applied for a variation of child support to comply with the Federal Child Support Guidelines and for the cancellation of arrears.
The British Columbia Supreme Court dismissed the application to vary the existing maintenance order of $200 per month per child. The application to cancel arrears was dismissed. Arrears were fixed at $21,400, with enforcement of payment suspended for at least one year. Specified access was ordered, with the mother to bear the transportation costs.
