Summary:
The applicants were serving prisoners at Drumheller Institution. They were convicted of offences which occurred while the Accelerated Parole Review regime was available. However, they were ineligible to benefit from that regime as they were sentenced after provisions of the Abolition of Early Parole Act (AEPA) came into effect on March 28, 2011. The applicants applied for a declaration that s. 10(1) of the AEPA violated their rights under s. 11(i) of the Charter.
The Alberta Court of Queen's Bench declared that s. 10(1) of the AEPA violated s. 11(i) of the Charter for those who offended prior to the AEPA coming into force on March 28, 2011 but were sentenced after that date, and it was accordingly of no force and effect in relation to those offenders.
