Practice - Topic 3742

Evidence - Letters rogatory - Jurisdiction to hear application for enforcement of letters rogatory - Supreme Court of Canada - S. 43 of the Canada Evidence Act, R.S.C. 1970, c. E-10, authorized an application for enforcement of letters rogatory to any court, including the Supreme Court of Canada - The applicant applied to the Supreme Court of Canada under s. 43 for the enforcement of letters rogatory from the courts of California and Illinois - The Supreme Court of Canada took jurisdiction over the application, but stated that such an application should be made to a provincial superior court instead of the Supreme Court of Canada or a court of appeal - See paragraphs 21 to 22.

Evidence - Letters rogatory - When evidence will be taken in jurisdiction receiving a request - Gulf Oil was the defendant in California and Illinois actions in connection with the alleged violation of United States anti-trust laws in uranium supply contracts - Gulf oil wished to obtain as evidence documents in Canada in the custody of two of its Canadian subsidiaries, Gulf Minerals and Gulf Canada - Both subsidiaries were willing to disclose the documents, but refused to do so for fear of violating the prohibition against disclosure in the Uranium Information Security Regulations under the Atomic Energy Control Act, R.S.C. 1970, c. A-19, s. 9 - The Regulations required the consent of the Minister of Energy, Mines and Resources for disclosure, which was refused - Gulf Oil obtained letters rogatory from the courts of California and Illinois for disclosure of the documents and applied to the Supreme Court of Canada under s. 43 of the Canada Evidence Act, R.S.C. 1970, c. E-10, for enforcement of the letters rogatory - The Supreme Court of Canada dismissed the application on the ground that enforcement of the letters rogatory would be contrary to the stated public policy of the Government of Canada requiring non-disclosure of such documents relating to the uranium industry - See paragraphs 18 to 35.
