Summary:

After undergoing a tubal ligation, Mrs. Kealey gave birth to a third healthy daughter. Mrs. and Mr. Kealey sued the doctor who performed the tubal ligation for negligence.

The Ontario Court (General Division) held that the doctor was negligent. The court awarded Mrs. Kealey $30,000 general damages for the pregnancy, labour and delivery and the necessity to undergo a second tubal ligation. The court awarded Mrs. and Mr. Kealey damages for loss of income and agreed special damages. The court declined, in the circumstances, to award damages for the costs of raising the child.
