PREFACE
To the Fourth Edition
The steady pace of Charter litigation has produced a long list of signif‌i-
cant developments since the publication of the t hird edition four years
ago. Notable among those developments are signif‌icant ch anges to the
way the Supreme Court has approached the interpretation of equality
rights and constitutional remedies including t he exclusion of evidence
under section 24(2) of t he Charter. We have done our best to ref‌lect
those developments in the preparation of this ed ition and, where ap-
propriate, to improve upon certain aspects of earlier editions. Although
Katherine Swinton did not pa rticipate in the preparation of t his edi-
tion or the third edition, we continue to benef‌it from her important
contribution to the f‌irst and second editions a nd sig nif‌icant portions
of the book continue to bear her mark. We thank James Reni han and
Tom McConville for their excellent re search assi stance. We also than k
our publishers, William Kaplan and Jeff Miller, for their conf‌idence and
support, and the st aff at Ir win Law for all their help in the production
of this edition.
