Summary:

In 1998, the husband was ordered to pay child support to his wife, under the Family Services Act (N.B.), for the benefit of their infant daughter. When the child reached 19 years of age, the husband applied to have the order revoked.

The New Brunswick Court of Queen's Bench, Family Division, in a deci­sion dated October 18, 1999, not reported in this series, rejected the husband's motion and ordered him to pay the arrears. The husband ap­pealed while still paying the arrears in ac­cordance with the order.

The New Brunswick Court of Appeal allowed the appeal. The court revoked the 1998 order and ordered the wife to reim­burse the husband any overpayment made pursuant to the trial decision.
