New Brunswick Court of Appeal
Ryan, Drapeau and Larlee, JJ.A.
May 25, 2000.
Summary:
In 1998, the husband was ordered to pay child support to his wife, under the Family Services Act (N.B.), for the benefit of their infant daughter. When the child reached 19 years of age, the husband applied to have the order revoked.
The New Brunswick Court of Queen's Bench, Family Division, in a decision dated October 18, 1999, not reported in this series, rejected the husband's motion and ordered him to pay the arrears. The husband appealed while still paying the arrears in accordance with the order.
The New Brunswick Court of Appeal allowed the appeal. The court revoked the 1998 order and ordered the wife to reimburse the husband any overpayment made pursuant to the trial decision.

Maintenance of wives and children - Maintenance of children - Termination of obligation - Age - The New Brunswick Court of Appeal considered the intention of the Legislature in interpreting legislation and applicable regulations and held that the Family Services Act does not compel a parent to provide support for a child once the child has reached 19, that is the age of majority.
