Summary:

The accused was convicted by a jury of sexual assault and indecent assault upon his stepdaughter. The accused was sentenced to eight years' imprisonment for sexual assault and five years' imprisonment, concurrent, for indecent assault. The accused appealed against sentence.

The Ontario Court of Appeal dismissed the appeal.

Criminal Law - Topic 5856

Sentence - Indecent assault - The accused commenced having sexual intercourse with his stepdaughter when she was six years old - This continued almost weekly and sometimes more frequently until after she was 14 (except when the accused was in prison) - No violence except on one occasion - Victim threatened - Victim's mother disbelieved her daughter and testified for the accused - Accused a violent man and a heavy drinker - Imprisoned in 1982 for attempted rape of the victim's eight year old girlfriend - Other convictions for assault, drinking and driving, wilful damage, theft and breach of probation - Pleaded not guilty, requiring victim to testify - Gross breach of parental trust - Profound effect on victim - The Ontario Court of Appeal affirmed sentences of eight years for sexual assault and five years concurrent for indecent assault.
