Summary:

The accused was convicted of three counts of possession of controlled substances for the purpose of trafficking contrary to s. 5(2) of the Controlled Drugs and Substances Act, and 13 counts relating to the possession of firearms, ammunition, and a restricted device contrary to the Criminal Code.

The British Columbia Supreme Court, in a decision reported [2012] B.C.T.C. Uned. 1338, sentenced the accused to a global sentence of five years, less 17 months credit for time served. The Crown appealed the sentence.

The British Columbia Court of Appeal allowed the appeal and increased the sentence for the three drug offences from three years on each count (concurrent) to five years and seven months (concurrent). That change would result in an actual global sentence of six years and seven months. In particular the court discussed sentencing where both weapons and drug offences were involved.
