Summary:

The accused was convicted by a jury of possession of a rifle for a purpose dangerous to the public peace, pointing a rifle, two counts of obstructing a peace officer in the execution of his duty, assaulting a police officer, using a rifle to commit an assault and using a rifle while obstructing a peace officer. The accused appealed, arguing, inter alia, that the trial judge refused to admit evidence relevant to the defence theory.

The Alberta Court of Appeal allowed the appeal and ordered a new trial.
