Summary:
The youth, in a judgment reported [2008] A.R. Uned. 199, was found guilty of second degree murder. The youth applied under s. 63(1) of the Youth Criminal Justice Act for an order that a youth sentence be imposed rather than an adult sentence. The onus was on the Crown to establish that a youth sentence would not be of sufficient length to hold the youth accountable.
The Alberta Court of Queen's Bench directed that a youth sentence be imposed and sentenced him to the maximum sentence (four years' custody, to be served in a federal penitentiary, followed by three years' conditional supervision in the community).

Young offenders - Decisions (incl. punishments) - Adult sentence (incl. place of custody) - The youth, now 20.5 years of age, was a heavy cocaine user who was indebted to the deceased - When the deceased threatened harm to the youth's family if the debt were not paid, the youth responded by threatening the deceased with a shotgun while robbing him and assisting in setting his trailer on fire - Both incidents were to intimidate the deceased - In May 2006, the youth entered the deceased's trailer and shot him once, killing him - He was convicted of second degree murder - The youth applied under s. 63(1) of the Youth Criminal Justice Act for imposition of a youth sentence - The onus was on the Crown to establish that a youth sentence would not be of sufficient length to hold the youth accountable - The youth spent 32 months in pre-trial custody, during which time he completed his high school and successfully completed virtually all treatment programs offered - However, his motivation to accept treatment and counselling outside of a custodial setting was suspect - He was assessed as a high risk to re-offend and "while treatable, requires a lengthy, comprehensive, multifaceted treatment program in the range of three years outside the prison setting that addresses his substance dependence and his anti-social behaviour" - The Alberta Court of Queen's Bench directed that a youth sentence be imposed and sentenced him to the maximum sentence (four years' custody followed by three years' conditional supervision in the community) - The youth received no credit for 32 months' pretrial custody and was to serve the four year sentence in a penitentiary - The court held that the total sentence of seven years, following 32 months' custody, was of sufficient length to hold the youth accountable for his offence.
