Summary:
Caissie was charged with impaired driving and driving while the concentration of alcohol in his blood exceeded the legal limit.
The New Brunswick Provincial Court acquitted Caissie. The Crown appealed the acquittal on the charge of impaired driving.
The New Brunswick Court of Queen's Bench, Trial Division, allowed the appeal and ordered a new trial. Caissie appealed.
The New Brunswick Court of Appeal allowed the appeal and restored the Provincial Court verdict.

Detention and imprisonment - Detention - What constitutes arbitrary detention - A police officer in a cruiser followed the car driven by the accused unto the latter's property in order "to check the driver's papers" - After asking the accused for his registration and insurance papers, the officer noticed signs of intoxication - The accused was arrested - He provided breath samples - He was charged with impaired driving - The New Brunswick Court of Appeal upheld the acquittal at trial - The court held that there had been no hot pursuit giving the officer the right to enter private property and therefore: (1) the order to stop was made without lawful authority; (2) the accused had been arbitrarily detained in violation of the Charter; (3) the evidence was obtained in violation of the right not to be arbitrarily detained; (4) this evidence should be excluded because of its conscriptive nature and it would have been impossible to discover it without violating the Charter.
