Résumé:

The accused pleaded guilty to the indictable offences of uttering threats to a police officer and breach of probation.

The New Brunswick Provincial Court sentenced the accused to nine months in jail, concurrent, for each sentence, account taken of remand time. The Crown appealed, with leave.

The New Brunswick Court of Appeal allowed the appeal. The court substituted consecutive sentences of nine months for each offence.

Sentencing - General - Consecutive sentences - On November 20, 2009, the accused was arrested for breach of probation - He was "aggressive and obnoxious" - After his remand hearing, the accused was transferred into the Sheriff's custody - During the transfer, the accused physically resisted and told every one present, police and Sheriff officers alike, to remember the place because he would be back and this would be another "Mayerthorpe" (where four R.C.M.P. officers were killed in 2005) - When a police officer warned the accused that he would be charged, he again threatened that the place would look like "Mayerthorpe" - The accused was charged with uttering threats to a police officer - He pleaded guilty to both charges - The trial judge sentenced him to nine months in jail, concurrent, for each sentence, account taken of remand time - The New Brunswick Court of Appeal substituted consecutive sentences of nine months where the two offences did not arise out of the same criminal transaction - See paragraphs 1 to 18.

Sentencing - General - Consecutive sentences - Reduced total term (totality principle) - The 44 year-old male accused pleaded guilty to the indictable offences of uttering threats to a police officer and breach of probation - The trial judge sentenced the accused to nine months in jail, concurrent, for each sentence, account taken of remand time - The trial judge noted that the accused had "one of the most extensive criminal records" that he had seen in years - The New Brunswick Court of Appeal ruled that the trial judge did not err on quantum but substituted consecutive sentences of nine months where the two offences did not arise out of the same criminal transaction - The court also ruled that the sentence of 18 months total was a fit sentence - The totality principle was respected given the gravity of the offences - Also, the accused had previously breached probation orders 11 times - See paragraph 18.
