Résumé:

The accused pleaded guilty to two counts of theft, one count of uttering a threat and one count of wilfully obstructing a peace officer.

The New Brunswick Provincial Court sentenced the accused to four months in jail, consecutive, for each theft count, followed by a two-year probation order, plus one month, concurrent for the other two offences. The Crown appealed, with leave.

The New Brunswick Court of Appeal allowed the appeal. The court increased the sentence for theft to nine months, consecutive, for each count, followed by a two-year probation order, plus one month, consecutive, for each of the two other offences. Total jail time: 20 months.

Sentencing - Appeals - Variation of sentence - Grounds for varying sentence imposed by trial judge - The accused pleaded guilty to two counts of theft, one count of uttering a threat and one count of wilfully obstructing a peace officer, after twice leaving a Jean Coutu pharmacy with a shopping cart full of unpaid items, and having a "violent reaction" when, after the second time, the store's loss prevention officer attempted to detain him - The sentencing judge, after noting that the accused's record was "horrendous", sentenced the accused to four months in jail, consecutive, for each theft count, followed by a two-year probation order, plus one month, concurrent for the other two offences - The New Brunswick Court of Appeal increased the sentence for theft to nine months, consecutive, for each count, followed by a two-year probation order, plus one month, consecutive, for each of the two other offences - Total jail time: 20 months - The sentence at first instance was unfit - The sentencing judge failed to give proper emphasis to the accused's prior record and the gravity of the offences - That record contained 96 convictions, including 26 convictions for theft - In addition, the "so-called step principle" required that the sentence for the present offences be greater than the one received for the previous ones - See paragraphs 1 to 23.
