The accused was convicted of contravening the provisions of the City of Red Deer Noise Bylaw (Bylaw No. 2626/79). He appealed, arguing that the bylaw was invalid for uncertainty.

The Alberta Court of Queen's Bench dismissed the appeal and affirmed the accused's conviction.

Bylaws - Quashing - Grounds - Uncertainty or vagueness - Noise bylaw - The City of Red Deer Noise Bylaw (Bylaw No. 2626/79), s. 3(a) prohibited persons from making "loud, un necessary or unusual noise or any noise whatsoever which either annoys, disturbs, injures, endangers or detracts from the comfort, repose, health, peace or safety of other persons" - The Alberta Court of Queen's Bench held that the wording of the bylaw was not uncertain and therefore the bylaw was valid.
