Summary:
Dumont, one of a group of five teens, was pushed down a set of stairs by one member of the group (M). M later punched Dumont in the face several times. The group continued on to the school, where Dumont was rendered unconscious by a brutal beating at the hands of the accused and M. The group left and returned two hours later. Dumont remained unconscious and was beaten again. Police arrived. Dumont died more than one week later because of severe brain damage. The accused was charged with murder on the basis that he was a party to the assault that was a significant cause of death (Criminal Code, s. 21(1)). The accused alleged that he was merely an observer and that the significant cause of brain damage was the fall down the stairs, which he had no part of.
The Alberta Court of Queen's Bench found the accused not guilty of murder, but guilty of the included offence of manslaughter. Causation was established where the court accepted that the assaults in which the accused participated, not the fall down the stairs, were the significant cause of the brain damage. However, the accused was not guilty of murder where it was not proved beyond a reasonable doubt that the accused possessed the subjectively held intent to kill Dumont or an intent to cause him bodily harm that he subjectively knew was likely to cause death. The requisite mens rea for manslaughter was established beyond a reasonable doubt.

Murder - General principles - Intention - Dumont was continually harassed and bullied by other teens in his group - One teen (M) pushed him down stairs - M later punched him in the head several times - When the group arrived at a school, Dumont was viciously beaten into unconsciousness - The accused was an active participant - Dumont was left there - When the group returned two hours later, Dumont was again beaten - Dumont died over a week later as a result of brain damage - The accused was charged with murder - The accused alleged, inter alia, that the actus reus was not established where the brain damage might have resulted from the fall down the stairs, which he had no part of - The Alberta Court of Queen's Bench held that the significant cause of death was the two beatings the accused actively participated in - Accordingly, the actus reus (causation) was established - However, the accused was not guilty of murder where it was not established beyond a reasonable doubt that the accused had the subjective intent to kill or the subjectively held intent to cause bodily harm that he subjectively knew was likely to cause death - The court found the accused guilty of manslaughter, where, inter alia, the accused was subjectively aware of the risk of death by the brutal beatings and was reckless as to whether death ensued.
