Summary:
Section 52(1) of the Young Offenders Act effectively denied a youth the right to a preliminary inquiry. A 14 year old youth charged with theft submitted that the unavailability of a preliminary inquiry violated his rights under ss. 1(b) and 2(e) of the Canadian Bill of Rights and s. 7 of the Charter of Rights and Freedoms. The Alberta Provincial Court held that there was no such violation. The youth appealed.
The Alberta Court of Appeal dismissed the appeal.
