Summary:

The accused was charged with indecently assaulting a female, contrary to s. 149 of the Criminal Code. The accused claimed s. 149 violated his equality rights under s. 1(b) of the Canadian Bill of Rights.

The Alberta Court of Queen's Bench quashed the charge. The court held that s. 149 violated s. 1(b) of the Canadian Bill of Rights and should be declared inoperative.

Civil Rights - Topic 5645

Equality and protection of the law - Sexual offences - Section 149 of the Criminal Code made it an indictable offence to indecently assault a female - Males were not afforded similar protection - The Alberta Court of Queen's Bench held that s. 149 violated equality rights under s. 1(b) of the Canadian Bill of Rights and was accordingly declared inoperative.
