Summary:

The accused was convicted of sexual assault and sentenced to two years less a day. The accused appealed both conviction and sentence.

The Ontario Court of Appeal dismissed the conviction appeal by endorsement on the record. The application for leave to appeal against sentence and the appeal itself was reserved.

The Court of Appeal, in the following decision, allowed the sentence appeal and substituted a sentence of 18 months' imprisonment.

Sentencing - Considerations - Rehabilitation - At a sexual assault trial the accused's evidence recklessly maligned the complainant and was palpably false - The Ontario Court of Appeal held that it was improper for the trial judge to increase an otherwise appropriate sentence because the accused gave evidence at trial which was construed as a series of blatant lies, demonstrating an absence of remorse and a need for rehabilitation - No application should be given to an unfavourable impression left by the accused's conduct at trial except to negate any other evidence of remorse which might have mitigated the fit sentence - See paragraphs 1, 3 to 16.
