Summary:

The accused was convicted of sexual assault of his former common law wife and her two daughters by a previous marriage, of assault of one daughter and of engaging in an act of anal intercourse with the other daughter when she was under age 18. The accused appealed the convictions.

The British Columbia Court of Appeal allowed the appeal in part, substituting an acquittal for the conviction respecting anal intercourse.

Sexual offences, public morals and dis­orderly conduct - Sexual offences - Sex­ual assault - Jury charge - Under the Criminal Code, s. 150.1(1), consent was not a defence to sexual assault respecting a complainant under 14 - The accused was charged with sexual assault of two young girls - Neither complainant could remem­ber exactly when the impugned activity began - The accused pleaded consent or honest belief in consent - The British Columbia Court of Appeal held that the trial judge erred in failing to instruct the jury that they had to find the complainants were under 14 beyond a reasonable doubt before they could apply s. 150.1(1) - Proof of age was an essential element in the operation of s. 150.1(1) and must be proved on a criminal standard - However, the omission could not have affected the result - See para­graphs 14 to 20.
