Summary:

The accused sexually assaulted a seven year old boy. After the assault was completed and the accused was dressed, the boy threatened to tell his mother. In return the accused threatened to kill the boy if he did so. Two minutes elapsed. Then, certain that the boy would tell his mother, the accused murdered him. The accused was convicted in Superior Court of first degree murder. On appeal, the Quebec Court of Appeal, in a judgment summarized at J.E. 85556, substituted a conviction for second degree murder. The Crown appealed to the Supreme Court of Canada.

The Supreme Court of Canada allowed the appeal and restored the conviction for first degree murder.
