Summary:
W.B.S. was convicted of two counts of sexual assault and sentenced to a total of three years' imprisonment. The victims were his stepson and stepdaughter. M.P. pleaded guilty to aggravated sexual assault of a young female relative and was also sentenced to three years' imprisonment. The Crown appealed the sentences in both cases. The appeals were heard together.
The Alberta Court of Appeal allowed both appeals. The court increased W.B.S.'s sentence to seven years' imprisonment and increased M.P.'s sentence to 5.5 years' imprisonment. The court reviewed the appropriate sentencing principles for major sexual assaults against children.

Sentencing - Considerations in imposing sentence - Sexual offences against children - The Alberta Court of Appeal stated that denunciation and general deterrence were the paramount sentencing considerations in cases of major sexual assaults on children - Rehabilitation was generally insignificant and not of paramount concern - The court stated that for sentencing there was a separate category of major sexual assault of a child by a parent or person in a position of control and trust and the starting point sentence for a single major sexual assault on such a child was four years' imprisonment - The court then discussed aggravating and mitigating factors that would increase or decrease the sentence - See paragraphs 3 to 42.

Sentence - Sexual assault - The accused was convicted of two counts of sexual assault - The accused had repeated anal intercourse with his stepdaughter and stepson beginning when they were six and eight years old respectively - Threats were used - The offences were planned and deliberate - The accused had no criminal record and showed no remorse - Serious breach of trust - The trial judge sentenced the accused to three years' imprisonment on each count (concurrent) - The Alberta Court of Appeal increased the sentences to seven years' imprisonment (concurrent) - See paragraphs 43 to 46.

Sentence - Aggravated sexual assault - The 20 year old status Indian accused pleaded guilty to aggravated sexual assault - The accused undressed a seven year old female relative, struck her in the head and body and had forced vaginal and anal intercourse with her - The accused was caught in the act, yet took the girl to a bedroom and repeated the acts - The girl was physically injured - The accused was allegedly drunk and had no criminal record - He spent three months in pretrial custody - Little remorse was shown - The girl was a relative, so the element of breach of trust was present, as opposed to the case of a total stranger - The Alberta Court of Appeal set aside a sentence of three years' imprisonment and substituted a sentence of 5.5 years' imprisonment - See paragraphs 47 to 59.
