Summary:
The accused was convicted of refusing to comply with a demand for breath samples. The accused appealed the conviction on the ground that the trial judge erred in holding that the accused had not been arbitrarily detained in violation of her s. 9 Charter rights.
The Saskatchewan Court of Queen's Bench allowed the appeal, set aside the conviction and entered an acquittal.

Detention and imprisonment - Detention - What constitutes arbitrary detention - The accused appealed her conviction of refusing to comply with a demand for breath samples - The Saskatchewan Court of Queen's Bench allowed the appeal and entered an acquittal - The court held that the accused had been arbitrarily detained where there was no evidence that the accused had breached any of the rules of the road, the police officer was not investigating some crime and the accused's vehicle was stopped because she had driven close to the centre line and then pulled off the highway and later returned to it - There was no basis for concluding that the police officer was executing some lawful duty when he stopped the accused's vehicle - The detention was not only arbitrary, it was unlawful and infringed the accused's rights under s. 9 of the Charter.
