Summary:

The accused pleaded guilty to possession of a narcotic for the purpose of trafficking contrary to s. 4(2) of the Narcotic Control Act and was sentenced to imprisonment for two years less a day. The accused appealed against sentence.

The British Columbia Court of Appeal dismissed the appeal.

Sentence - Possession of narcotic (cocaine) for purpose of trafficking - A 37 year old drug addict was found in possession of 6.5 grams of cocaine and $1,470 in cash and other indicia of the drug trade - The accused had just been released from prison on a similar conviction and was still on probation - The accused had never been gainfully employed - The British Columbia Court of Appeal dismissed the accused's appeal from a sentence of imprisonment for two years less a day.
