Summary:

Two actions were commenced under the Class Proceedings Act against the defendants, the "Simmonds Action" and the "Locking Action". The plaintiffs in each action sought carriage of the class action.

The Ontario Superior Court, in a decision reported at [2012] O.T.C. Uned. 44, granted carriage of the class action in favour of the Simmonds Action. The Locking action was stayed. Locking appealed that order.

The Ontario Court of Appeal held that it lacked jurisdiction to hear the appeal. The appeal lay to the Divisional Court.

Provincial courts - Ontario - Court of Appeal - Jurisdiction - Appeals from interlocutory orders - Two actions were commenced under the Class Proceedings Act (CPA) against the defendants, the "Simmonds Action" and the "Locking Action" - A motion judge granted a motion for carriage of the class action in favour of the Simmonds Action - The Locking Action was stayed - Locking appealed that order - The Ontario Court of Appeal held that it lacked jurisdiction to hear the appeal - The majority of appeals under the CPA were to the Divisional Court - Those that were not specifically addressed in the CPA were governed by s. 6(1)(b) of the Courts of Justice Act - Under s. 6(1)(b), the issue was whether the appeal was from a final or interlocutory order - The motion judge's order was interloctory - The stay of proceedings did not determine or terminate Locking's claim - Therefore, the appeal lay to the Divisional Court.
