Summary:
Doak appealed an order of committal made by Holmes, J., under the Extradition Act, S.C. 1999, c. 18 (see [2013] B.C.T.C. Uned. 224). He also sought judicial review of an order of surrender to the United States of America issued by the Minister of Justice. Doak was alleged to have participated in a drug trafficking conspiracy. He submitted that: (1) the extradition judge failed to properly apply the test for committal as set out in the United States of America v. Ferras (2006 S.C.C.); (2) the extradition judge erred in refusing to allow him to call evidence at the committal hearing; (3) the Minister's decision to order his surrender was not reasonable; and (4) the Minister should have refused surrender on the basis of the undue and unreasonable delay, and the prejudicial effect thereof.
The British Columbia Court of Appeal dismissed both the appeal from the committal order and the application for judicial review of the surrender order.
