A. LOW INCOME EARNERS
e provincia l or territorial tables under the Federal Child Support Guideline s have a min-
imum annual income or poverty threshold below which no f‌ixed amount of basic child
support is payableand any existing order should be terminated.In these circumstances,
however, a court may direct the non-custodial parent to provide the custodial parentor the
provincial maintenance enforcement of‌f‌icewith f‌ina ncial s tatement s at design ated inter-
vals.
Whereaparentisrelievedofthelegalobligationtopaythebasicamountoftablesup-
portbecausehisorherincomefallsbelowtheminimumthreshold,acourtmayalsoreject
anyclaimtoexpensesundersectionoftheFederal Child Support Guidelines even though
“means” under sect ion () of the Guidelines i s a broader concept than income earn ing cap-
acity in that “means” includes all of a person’s pecuniary resources, capital assets, income
from employment or earn ing capacit y, and any other source from which a person receive s
gains or benef‌its, togetherw ith,in certain circumstances,money whichthe person doesnot
have in possession but which is avai lable to that person. e f act that the g uidelines doe s
not prescribe a basic c hild support p ayment for parents wit h income below the mi nimum
threshold ref‌lects the reality that everyone requires a certain amount of money simply to
survive.Itwouldappeartobeirrationalifaparentwhoisunabletopaythebaselevelof
