Summary:

This case arose out of a charge of break and enter. The accused pleaded not guilty and was convicted at trial by a judge sitting without a jury. The accused appealed to the Ontario Court of Appeal.

The Ontario Court of Appeal dismissed the appeal without written reasons. The accused appealed to the Supreme Court of Canada.

The Supreme Court of Canada dismissed the appeal.

Evidence - Confessions and voluntary statements - Voir dire, waiver of - The Supreme Court of Canada stated that the voluntariness of a confessional statement may be determined without a voir dire where the voir dire is waived by an accused or his counsel (see paragraph 13) - The Supreme Court of Canada stated that such a waiver constitutes an admission that the statement in question was not made in circumstances where the accused person was the subject of coercion (see paragraph 13).
