Summary:
The accused was convicted of rape before a judge and jury. The accused was charged with 15 offences relating to sexual assaults over four years. The Alberta Court of Queen's Bench ordered that the counts be severed in a judgment reported 24 A.R. 515, and the Crown proceeded on the earliest one, which led to the accused's conviction. The trial judge ruled that evidence regarding the other 14 offences was admissible against the accused on the ground that it was relevant, because the other incidents were similar, notwithstanding that there was no evidence linking the accused to 11 of them. The accused appealed. The Alberta Court of Appeal dismissed the appeal in a judgment reported 26 A.R. 208. The accused appealed.
The Supreme Court of Canada allowed the appeal and ordered a new trial and held inadmissible evidence respecting the 11 offences which could not be linked to the accused.
