REMEDIES & RESTITUTION
The resolution of most legal disputes involves an order by the court for a particular remedy
to be made to the aggrieved party. There is a range of remedies, from proscribing certain ac-
tivities by one party (e.g., injunctions) to requiring compensation to the injured party (restitu-
tion). The primary basis for this area of law can be found in jurisprudence and also in court

Nouveauté au Code civil du Québec, la restitution des prestations couvre uniformément un en-
semble de situations où les parties reviennent à l’état antérieur à leurs engagements. C’est donc
